Blair Software Terms of Use
Effective date: October 18, 2026
These Terms of Use (the “Terms”) are an agreement between Blair Software, LLC (“Blair
Software”, “we”, “us”) and the person or business that visits or uses our company website at
blairsoftware.com and www.blairsoftware.com (the “Site”).
By using the Site, you agree to these Terms. If you don’t agree, don’t use the Site.
These Terms cover the company Site only. Our products—including MyBillables at
mybillables.com—have their own terms of service. Custom web and mobile development work is
governed by a separate written agreement with you, not by these Terms alone.
1. The Site
The Site describes Blair Software, our products, and how to contact us. It is informational. It does not create a product subscription, and browsing it does not form a development contract.
Links to MyBillables or other products take you to those products’ own sites and agreements.
2. Acceptable use
You may use the Site for lawful purposes. You won’t:
- break the law or infringe anyone’s rights;
- attempt to disrupt, overload, or gain unauthorized access to the Site or related systems;
- probe, scan, or test vulnerabilities without our written permission (responsible disclosure goes
to
security@blairsoftware.com); - scrape or harvest content in a way that harms the Site or violates these Terms;
- send malware, spam, or deceptive content through any contact path we provide.
3. Intellectual property
We and our licensors own the Site, including its design, text, graphics, and the Blair Software name and logos. You may not copy, modify, distribute, or create derivative works from the Site except for ordinary browsing and sharing of public pages with attribution, or with our written permission. You may not use our trademarks without our permission.
4. Third-party sites and products
The Site may link to third-party websites and to our product sites. We aren’t responsible for their content, privacy practices, or terms. Your use of MyBillables or another product is governed by that product’s terms and privacy policy.
5. Custom development inquiries
If you contact us about custom web or mobile development, any engagement starts only when we both agree in writing on requirements, scope, pricing, and ownership. You own the finished code for work we deliver under that agreement, as the agreement states. Emails alone don’t create a binding development contract unless they clearly say so and both parties accept.
6. Privacy
How we collect and use personal information on the Site is described in our Privacy Policy.
7. Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don’t warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Information on the Site about products, pricing, availability, or custom work is general and may change. It isn’t a binding offer unless we say so in a separate written agreement.
8. Limitation of liability
TO THE EXTENT THE LAW ALLOWS, WE AREN’T LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE, EVEN IF ADVISED OF THEIR POSSIBILITY.
TO THE EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY ARISING OUT OF THESE TERMS OR THE SITE IS LIMITED TO $100.
Some jurisdictions don’t allow certain limitations. In those places, our liability is limited to the maximum extent permitted.
9. Indemnification
You’ll defend and indemnify us against third-party claims arising from your misuse of the Site or your breach of these Terms, and pay the resulting damages awarded or settlements you agree to.
10. Changes to these Terms
We may update these Terms. We’ll post the revised Terms on the Site and update the effective date. Continued use of the Site after changes take effect means you accept the updated Terms. If you don’t agree, stop using the Site.
11. General
11.1 Governing law. These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. The UN Convention on Contracts for the International Sale of Goods doesn’t apply.
11.2 Venue. The state and federal courts in Texas, United States have exclusive jurisdiction, and each party consents to them. Either party may seek injunctive relief in any court to protect its intellectual property or confidential information.
11.3 Notices. We may post notices on the Site. Send legal notices to legal@blairsoftware.com.
11.4 Entire agreement. These Terms and the Privacy Policy are the entire agreement about use of the Site. Separate product terms and custom-development agreements control those relationships.
11.5 Severability and waiver. If a provision is unenforceable, the rest stays in effect. Not enforcing a provision isn’t a waiver.
11.6 Contact. Questions about these Terms: legal@blairsoftware.com.
